Terms and Conditions of Use for Emaar Global

Please review these Terms and Conditions carefully before utilizing our services.

Interpretation and Definitions Interpretation
Terms beginning with a capital letter are defined below and retain the same meaning  whether used in singular or plural form.
Definitions
– Affiliate: An entity that controls, is controlled by, or shares common control with a party.
– Country: United Arab Emirates.
– Company (referred to as “Emaar Global,” “we,” “us,” or “our”): Emaar Global and its  Affiliates, associates, and related entities, located at Office 212, Arzoo Building, Al Twar Center, Al Nahda Road, Dubai, United Arab Emirates.
– Device: Any device capable of accessing our services, such as a computer, smartphone, or tablet.
– Service: Refers to the Emaar Global website.
– Terms and Conditions (“Terms”): This document outlines the full agreement between you  and Emaar Global regarding Service usage.
– Third-Party Service: Any external service or content integrated or accessible via our Service.
– Website: Emaar Global, accessible at www.emaarglobal.ae.
– You*: The individual or entity accessing or using the Service.
These Terms govern your engagement with Emaar Global and its Affiliates (“Company,”
“we,” or “us”), a UAE-based consultancy providing business support solutions. By using our
services, you (“Client”) agree to abide by these Terms.
1. Scope of Services and Engagement
1.1 General Services
Emaar Global delivers customized consultancy and facilitation services to meet your business requirements. The specifics, scope, and duration of services will be detailed in formal proposals, invoices, or written contracts, which may involve coordination with third-party providers or governmental bodies as needed.
1.2 Third-Party Payment Handling
We may handle payments to government agencies, legal entities, banks, or other third parties on your behalf as part of service delivery. These transactions align with the subscribed service terms but do not imply our authority over third-party decisions.
2. Our Rights and Responsibilities
2.1 Professional Conduct
We are dedicated to delivering services with due care, professionalism, and adherence to industry standards and UAE regulations.
2.2 Limitation of Liability
Emaar Global is not liable for indirect, incidental, or consequential damages, including loss of profits, revenue, or reputation, arising from service provision. Our liability is restricted to fees paid for the specific service and excludes issues beyond our control, such as third-party actions or regulatory delays.
2.3 Information Accuracy
We provide clear and current information at the outset, including procedures and timelines.However, we cannot account for external regulatory changes affecting these terms.
2.4 Third-Party Changes
Any updates to fees, policies, or timelines by third parties or authorities post-agreement will be promptly communicated to you.
2.5 Exemption from Third-Party Changes
We are not responsible for modifications imposed by third parties or authorities after agreement signing, including changes to costs or service requirements beyond our influence.
2.6 KYC Documents and Client Onboarding
During onboarding, you must submit information, documents, and materials (“KYC Documents”) to support our Anti-Money Laundering/Counter-Terrorism Financing (AML/CFT) obligations. These may include identity proof (e.g., passport), address verification (e.g., utility
bill), corporate documents, beneficial ownership details, and source of funds declarations. Emaar Global reserves the right to reject applications, terminate relationships, or halt transactions if:
– Required KYC Documents are not provided.
– Submitted information is incomplete, inaccurate, false, or misleading.
– Due diligence cannot be satisfactorily completed.
– The Client or related party poses an AML/CFT risk.
– We suspect illegal activities, including money laundering or terrorism financing.
– Acceptance violates AML/CFT laws or our internal policies.
– Any other reasonable risk-based concern arises.
3. Client’s Rights and Responsibilities
3.1 Compliance
Clients must comply with UAE laws and regulations, refraining from unlawful or unethical activities while using our services.
3.2 Use of Services
Services are intended solely for the Client’s use and are non-transferable without our written approval.
3.3 Payment and Documentation
Clients are obligated to provide accurate documents and make timely payments per agreed schedules. Delays may affect service delivery.
3.4 Third-Party Terms
Clients must follow terms set by third-party providers. Emaar Global is not liable for third-party service failures.
3.5 Right to Information and Indemnification
You are entitled to accurate service details. You agree to indemnify us against losses from changes to terms or conditions post-agreement, driven by external factors beyond our
control.
4. Payment Terms
4.1 Advance Payment
Services require upfront payment unless otherwise agreed in writing, ensuring resource allocation.
4.2 Fee Structure
Fees are detailed in signed agreements or proposals, stated in UAE Dirhams unless otherwise noted.
4.3 Invoicing & Disputes
Invoices must be settled within specified terms. Disputes must be raised in writing immediately, with undisputed amounts payable during resolution.
4.4 Adjustments
Fees may be adjusted due to scope changes, client delays, or regulatory updates, with prior notice.
4.5 Third-Party Fees
Clients are responsible for third-party costs (e.g., government fees). We may pay these on your behalf, invoiced separately.
5. Deferred Payment Policy
5.1 Eligibility for Deferral
Deferred payments may be approved at our discretion, subject to Freezone or authority rules, potentially requiring post-dated cheques or guarantees.
5.2 Deferral Request Timeline
Requests must be submitted within 15 days of the due date without penalty; beyond this, a 10% monthly deferral fee applies.
5.3 Deferral Limitations and Penalties
Up to two deferrals are allowed per 12-month cycle. Repeated delays or dishonored cheques may lead to service suspension and a AED 300–500 returned cheque fee, depending on the amount.
5.4 Submission Process
Submit deferral requests in writing at least 7 business days before the due date to
accounts@emaar-global.com.
6. Cancellation Policy
6.1 Cancellation by Emaar Global
Non-payment may result in service suspension or termination with notice. Reactivation may incur additional fees.
6.2 Cancellation by Client
Submit written cancellation requests to your account manager. Cancellations after service start may forfeit partial or full fees.
6.3 Refunds
Partial refunds may apply if a government authority rejects a service, subject to their timelines and administrative deductions. Other refunds are issued only if services are uninitiated, with third-party or government fees deducted. Completed or started services are
non-refundable. We may retain 15% of the total invoiced amount or AED 1,050 (whichever is higher) as a service fee. Refund requests are subject to our discretion, and this policy may be updated without prior notice.
6.4 Withdrawal Before Submission
A 15% handling fee applies if you withdraw before authority submission.
6.5 Forfeiture
Failure to proceed within two months of payment may result in forfeiture, ending our obligations. Reinstatement requires a new agreement, except in force majeure cases with timely written notice.
7. Exit Policy
7.1 License Cancellation or Transfer
A AED 5,000 fee applies for a No Objection Certificate (NOC) to deal directly with authorities or other providers.
7.2 Termination of Service Obligations
File transfers to authorities conclude our responsibilities, with future dealings managed directly by them.
7.3 Document Return Requirement
Return all original setup documents. Lost or damaged documents may require a police report.
7.4 Payment of Pending Installments
Outstanding installments must be cleared before license cancellation. Late cancellations post-expiry incur penalties.
8. Force Majeure
Neither party is liable for delays or failures due to events beyond reasonable control, such as natural disasters, war, or government orders. Obligations resume post-event.
9. General Terms
9.1 Notice & Communication
Notices must be in writing to the provided email or address.
9.2 Entire Agreement
These Terms form the complete agreement, superseding prior understandings.
9.3 Assignment
Rights or obligations cannot be assigned without written consent.
10. Website Terms of Use
10.1 Acceptance of Terms
Accessing the Emaar Global website (“Site”) signifies your acceptance of these Terms. Non-acceptance requires discontinuation of use.
10.2 Website Access and Use
The Site offers general information and communication tools, not professional or legal advice.
10.3 Privacy and Data Protection
We protect your data per UAE Federal Decree Law No. 45 of 2021, using it solely for service delivery, enhancement, and legal compliance. See our Privacy Policy for details.
10.4 Intellectual Property Rights
Site content (text, graphics, etc.) is Emaar Global’s property, protected by law. You may view or print for personal use but not republish, modify, or use commercially.
10.5 Website Modifications
We may suspend or alter the Site without notice for operational or legal reasons.
10.6 Accuracy and Liability
Information is provided as-is; we are not liable for losses from reliance on Site content.
10.7 Links to Third-Party Websites
Linked sites are not our responsibility; review their terms.
10.8 Cookies and Tracking Technologies
Cookies enhance your experience and analyze traffic. Essential cookies are stored with consent; manage preferences via browser settings.
10.9 Viruses and Misuse
We do not guarantee a virus-free Site. Secure practices are your responsibility; misuse is prohibited.
10.10 Suspension or Ban of Users
We may restrict access for breaches or harmful behavior.
10.11 Changes to Terms
Updates may occur; continued use implies acceptance.
10.12 Translation Interpretation
The English version prevails if translated.
10.13 U.S. Compliance
You confirm no U.S. sanctions apply.
10.14 Severability and Waiver
Unenforceable provisions are adjusted; non-enforcement does not waive rights.
10.15 Effective Date and Updates
Effective 20th July 2025, last updated 20th July 2025. Changes are posted immediately;
review regularly.
10.16 Modifications to Service
We may modify or discontinue services without notice.
11. Estimated Timelines
– Company Formation: License: 5-7 working days; Establishment Card/E-Channel: 4 days
post-license.
– New Visa: Entry Permit: 3-4 days; Change Status: 1-2 days (in-country);
Medical/Biometrics: 3-4 days; Visa Stamping: 2-3 days; Emirates ID: 3-4 days.
12. Governing Law and Jurisdiction
Governed by UAE law, with disputes under Dubai courts’ jurisdiction.
13. Dispute Resolution
Attempt informal resolution by contacting us in writing at Office 212, Arzoo Building, Al Twar Center, Al Nahda Road, Dubai, United Arab Emirates, or customerservice@emaar-global.ae within 14 days. Unresolved disputes fall to Dubai courts, except for injunctive relief sought by Emaar Global.
